Sec. 21-7. Trees near streets, sidewalks or drives.
Trees shall not be placed nearer than three (3) feet nine (9) inches to sidewalks and curbs, unless an approved means to control root growth, such as special curbing, is provided, and shall be spaced sufficiently to prevent interference of adjacent trees when mature. Roots of any tree or other plant which tend to damage or interfere with sidewalks, curbs or drives shall be corrected by the owner of the tree or plant and any sidewalk, curb or drive thus damaged shall be repaired by such owner in a manner approved by the director of public works. Trees shall be maintained to give a vertical clearance of seven (7) feet over walks and ten (10) feet over streets.

Sec. 28-170. Landscaping.
(a) Landscaping definition. Landscaping shall be defined for the purpose of these requirements as plant material, including but not limited to grass, trees, shrubs, flowers, vines and other ground covers, natural land forms, water forms, planters, walks and plaza areas.
(b) Site definition. Site shall be defined for the purposes of these guidelines as any plot, tract or parcel of land or combination of contiguous lots, tracts, or parcels of land which is developed (or intended for development) according to an overall site plan. A "site" shall be exclusive of any land dedicated for public use through the platting process.
(c) Compliance.
(1) Any required landscaping shall be complete prior to the issuance of the certificate of occupancy, or within ninety (90) days of the date of the certificate of occupancy with approval of the building official and satisfactory financial assurance that the landscaping will be completed.
(2) Every site located between the structure and the highway right- of-way used for a parking area shall include a buffer strip, landscaped and curbed, being a minimum of five (5) feet in depth.
(3) All landscaping shall be installed so as to avoid hazards as outlined in the City of Denison's Code of Ordinances.
(4) An effort shall be made to preserve existing trees.

Sec. 28-171. Screening.
(a) Screening of nonresidential uses from residential uses.
(1) Side yards, rear yards and service sides. Side yards, rear yards, and service sides of nonresidential uses abutting residential uses shall be screened.
(2) Screening height. Screening height shall be a minimum of six (6) feet above the grade at the property line of abutting residential uses.
a. In cases of extreme height differential, the following guidelines apply: Adjust screening height requirements or alter material requirement (e.g. including, but not limited to, the use of canopy forming trees where nonresidential use is at a much lower grade than the residential use).
b. All landscaping shall be installed so as to avoid hazards as outlined in the City of Denison Code of Ordinances.
(3) Materials and methods.
a. Masonry wall shall be defined as an exterior wall consisting of brick, stone, rock, marble or the built-up panels of these materials designed for exterior use.
b. Earthen berms shall have a maximum side slope of 3:1 and shall be entirely vegetated with turf or groundcover.
c. Evergreen shrubs of sufficient height when used alone or in conjunction with other material meet the minimum height requirements of this section.
d. Privacy fences shall consist of solid wood or solid masonry fence material.
e. To meet requirements of this section, the developer may use a combination of any two (2) materials allowed in this section to meet minimum height requirements.
(b) Screening of site features. Site features hereinafter shall be screened in accordance with (a)(3) of this section.
(1) Rear yards and service sides. Where the rear yard, side yard or service side of a nonresidential use is adjacent to a public thoroughfare and screening of the use is not specifically addressed elsewhere in this article, it shall be screened according to (a)(3) of this section.
(2) Loading docks. Freight docks, service bays, loading docks, truck berths, and heavy vehicle storage areas shall be screened from all abutting uses except when the abutting use is determined to be of equal or greater intensity. The aforementioned areas shall be screened from all thoroughfares.
(3) Outdoor storage area. Outdoor storage of merchandise, equipment, or materials which is essential or incidental to the use and which is not on temporary display of the purpose of being immediately available for sale to the public at large shall be screened from all public thoroughfares and abutting uses.
(4) Refuse areas. All refuse storage areas shall be screened.
(5) Ground-mounted equipment. All ground-mounted equipment including, but not limited to, pad mounted transformers, tele
phone switch boxes, and gas meters, shall be reasonably screened or located away from the view of public thoroughfares and from the view of adjacent properties. Whenever possible, appurtenances for utility services shall be installed at the rear of the structure which they service.

Sec. 18-113. Damaging, removing, etc., park property.
It shall be unlawful for any person to cut, pull, break, bruise, remove or in any manner injure any tree, shrub or vegetation of any kind growing in any city park or to injure, deface or in any way interfere with any chair, bench, seat or hydrant, frame, fence, gate or structure of any kind therein or thereon or connected therewith. This section shall not apply to anything done by the lawful employees of the city in the lawful performance of their duties, or under their authority or direction.
